Terms of Service

These Terms of Service ("Terms") govern your use of ACSVirtualChurch.com, any member account, and any product or service purchased from ACS Virtual Church ("ACS Virtual Church," "ACS," "we," "us," or "our").
By accessing the website, creating an account, submitting information, making a donation, purchasing a service, or checking a box indicating acceptance, you agree to these Terms and our Privacy Policy and Refund Policy.
If you do not agree, do not use the website or purchase our services.
1. ELIGIBILITY AND AUTHORITY
You must be at least 18 years old and legally capable of entering a binding agreement.
If you are purchasing on behalf of a church, ministry, school, organization, business, or another person, you represent that you are authorized to bind that organization or person to these Terms.
2. ACS VIRTUAL CHURCH
ACS Virtual Church is a virtual Christian church organization that provides religious content, member resources, prayer-request services, church-school technology, website-development services, administrative systems, hosting, maintenance, curriculum products, and related support.
The website does not provide legal, tax, accounting, accreditation, licensing, educational, medical, mental-health, or professional advice.
Religious information, prayer, sermons, devotionals, and other content are offered for spiritual and informational purposes. They are not substitutes for emergency assistance, medical treatment, counseling, legal advice, or other professional services.
If you are experiencing an emergency, contact 911 or the appropriate emergency service.
3. INDEPENDENT CHURCH SCHOOLS
Church schools created for customers are independently owned and operated by their respective churches, ministries, organizations, or owners.
Purchasing a church-school system from ACS Virtual Church does not:
- Make the customer's school part of ACS Virtual Church;
- Make ACS Virtual Church the owner or operator of the customer's school;
- Create a partnership, joint venture, franchise, agency, employment relationship, affiliation, or legal association;
- Authorize the customer to represent that ACS Virtual Church sponsors, covers, accredits, licenses, approves, or operates the customer's school;
- Guarantee that the customer qualifies as a church school under Alabama law or the laws of any other state;
- Provide the customer with nonprofit or tax-exempt status;
- Provide accreditation, state approval, licensing, legal recognition, or government authorization; or
- Guarantee that another school, college, employer, government agency, military branch, or organization will accept the customer's records, transcripts, diplomas, credits, or curriculum.
ACS Virtual Church provides technology, administrative tools, and related services. Each customer is solely responsible for legally establishing, operating, managing, and maintaining their own church, ministry, church school, or educational organization.
4. CUSTOMER LEGAL RESPONSIBILITIES
Every church-school customer is responsible for determining and complying with all laws, regulations, reporting requirements, attendance requirements, privacy requirements, recordkeeping duties, tax obligations, business requirements, and educational rules that apply to the customer's organization and families.
Customers should consult a qualified attorney and tax professional before opening or operating a church school.
The customer is solely responsible for:
- The legal formation and operation of its church or ministry;
- Determining whether its school satisfies the legal definition of a church school;
- Enrollment and withdrawal decisions;
- Student attendance and educational records;
- Tuition, fees, refunds, and financial disputes with families;
- Parent and student communications;
- Required notices and filings;
- Curriculum decisions and graduation requirements;
- Transcripts, diplomas, report cards, and other school records;
- Privacy notices, parental consent, and protection of student information;
- Compliance with children's privacy and education-record laws;
- Website content, policies, representations, and advertising;
- Obtaining permission to use names, logos, photographs, documents, and other materials;
- Maintaining accurate administrative and family information; and
- Decisions made using information generated or stored in the system.
ACS Virtual Church does not monitor or supervise the daily operation of a customer's school.
5. CHURCH-SCHOOL SYSTEM SERVICES
Depending on the package and add-ons purchased, services may include a custom website, enrollment system, parent portal, administrative dashboard, document-generation tools, attendance tracking, email notifications, school records, transcript and diploma tools, domain registration, hosting, maintenance, technical support, or other listed features.
Only features specifically included in the customer's written order, invoice, checkout page, or agreed project scope are included.
Requests beyond the original scope, including major design changes, new pages, custom programming, integrations, redesigns, rewritten content, additional features, or changes requested after the revision period, may require an additional fee.
6. PROJECT START AND COMPLETION
Work begins after ACS Virtual Church receives:
- Full payment of the required setup fee and first service period;
- A completed intake form;
- All reasonably required information, documents, branding, policies, and content; and
- Any approvals or access needed to complete the project.
Any quoted completion date is an estimate and not a guaranteed deadline.
Customer delays, incomplete information, requested changes, third-party outages, technical problems, emergencies, acts of God, or circumstances outside our reasonable control may extend the completion date.
ACS Virtual Church is not responsible for delays caused by the customer's failure to provide information, content, approvals, feedback, access, or payment.
7. SEVEN-DAY REVISION PERIOD
Once ACS Virtual Church notifies the customer that the initial system is complete, the customer has seven calendar days to request reasonable minor revisions.
Minor revisions include small wording corrections, replacement of supplied images, minor color adjustments, correction of customer-provided information, and similar finishing changes.
Minor revisions do not include major redesigns, substantial rewriting, new functionality, new pages, new forms, changes to the original project direction, replacement of previously approved work, custom integrations, or other work outside the original scope.
Requests received after the seven-day revision period, or requests determined to be outside the original scope, may be declined or quoted as additional paid work.
Failure to submit requested revisions within seven calendar days constitutes acceptance of the completed project.
8. CUSTOMER DELAYS AND ABANDONED PROJECTS
The customer must respond to reasonable requests for information or approval.
Customer delays automatically extend all estimated delivery dates.
If a customer fails to respond for 30 consecutive days, ACS Virtual Church may archive the project and consider the project inactive. Payments already made remain nonrefundable.
Reactivating an inactive project may require payment of a reactivation fee or a new project quote based on current pricing and availability.
9. FEES AND PAYMENT
All prices are stated in United States dollars unless otherwise indicated.
Customers agree to pay all setup fees, recurring service fees, add-on charges, domain charges, taxes, transaction costs, and other amounts displayed at checkout or included in an agreed invoice or order.
ACS Virtual Church may change pricing for future purchases or renewal periods. When reasonably practical, notice of a recurring-service price change will be provided before the new price takes effect.
10. RECURRING SERVICE AND AUTOMATIC BILLING
The ongoing monthly service may include hosting, maintenance, system updates, platform access, technical support, and other services included with the customer's package.
By purchasing a recurring service, the customer authorizes ACS Virtual Church and its payment processor to charge the payment method provided at the stated billing frequency until the service is canceled.
Cancellation stops future renewals but does not produce a refund, credit, or prorated reimbursement for the current billing period.

11. FAILED OR LATE PAYMENTS
ACS Virtual Church may suspend hosting, website access, administrative access, technical support, updates, email functions, document functions, or other services when a payment is declined, late, disputed, reversed, or unpaid.
Outstanding balances must be paid before services are restored. Restoration may require an additional fee when substantial work is needed.
12. DOMAIN NAMES
When a domain name is included for the first year, the offer applies only to a standard available domain selected and approved during setup.
Premium domains, previously registered domains, brokerage fees, legal disputes, special extensions, and third-party acquisition costs are not included unless expressly stated.
Domain renewals, transfers, and related fees are nonrefundable.
13. CURRICULUM AND DIGITAL PRODUCTS
Curriculum, worksheets, assessments, lesson plans, downloads, templates, generated materials, and other digital products are licensed for use by the purchasing customer and its authorized users.
Unless written permission is provided, customers may not resell, sublicense, publish, redistribute, share publicly, copy for another school, remove ownership notices, or make the materials available to unauthorized parties.
ACS Virtual Church does not guarantee any particular academic result, grade level, test score, credit transfer, college acceptance, or educational outcome.
14. OWNERSHIP OF TECHNOLOGY
Customers retain ownership of their original school name, logo, written content, photographs, records, and other materials they lawfully provide.
ACS Virtual Church and its licensors retain ownership of the underlying platform, software, source code, system architecture, templates, administrative tools, document generators, automation, processes, designs, curriculum, and reusable technology used to provide the services.
Payment for setup does not transfer ownership of ACS Virtual Church's source code, platform, software, templates, curriculum, or proprietary technology unless a separate written agreement expressly states otherwise.
15. CUSTOMER CONTENT AND LICENSE
The customer represents that it owns or has permission to use everything submitted to ACS Virtual Church.
The customer grants ACS Virtual Church a limited license to host, copy, format, modify, display, transmit, and otherwise use submitted content as reasonably necessary to build, operate, maintain, and support the customer's system.
16. CUSTOMER DATA AND DATA EXPORTS
The customer owns the school and family records entered into its system, subject to applicable law.
When service ends, the customer may request a reasonably available export of customer-provided data within 30 days, provided the account is paid in full.
After the applicable retention period, data may be deleted, deidentified, or made inaccessible unless retention is required by law.
17. ACCOUNTS AND SECURITY
Users are responsible for protecting usernames, passwords, and account credentials.
ACS Virtual Church may suspend or terminate accounts that create a security risk, violate these Terms, misuse the system, or threaten other users.
18. MEMBER AREA AND DIRECTORY
Membership accounts and access to member resources are privileges, not guaranteed rights.
Information designated for the member directory may be visible to other authenticated members. Members must not copy, scrape, sell, publish, or use member information for harassment, unsolicited marketing, or any unlawful purpose.
19. PRAYER REQUESTS
Prayer requests are treated with care, but submission does not create a legally privileged, professional, medical, counseling, or confidential relationship.
Prayer requests marked private are intended to be limited to church leadership or authorized prayer personnel. However, no electronic system can guarantee absolute confidentiality or security.
20. DONATIONS
Tithes and donations are voluntary contributions supporting the ministry.
Unless required by law, donations are final, irrevocable, and nonrefundable.
ACS Virtual Church does not guarantee that a donation is tax-deductible. Donors should consult their own tax professional.
21. PROHIBITED CONDUCT
Users may not: violate any law or regulation; misrepresent a relationship with ACS Virtual Church; use the system for fraud, harassment, abuse, discrimination, or unlawful activity; upload malware or attempt unauthorized access; interfere with the website or another user's account; scrape, copy, reverse engineer, or exploit the platform; submit false, misleading, infringing, or unlawful content; collect or disclose personal information without proper authority; use ACS Virtual Church's name, logo, materials, or reputation without permission; or resell or redistribute services or materials without written authorization.
22. THIRD-PARTY SERVICES
The website and customer systems may use third-party services such as Stripe, hosting providers, email providers, analytics services, domain registrars, YouTube, and other platforms.
ACS Virtual Church is not responsible for third-party outages, policy changes, account decisions, security incidents, processing delays, service limitations, or discontinued features.
23. NO GUARANTEED RESULTS
ACS Virtual Church does not guarantee enrollment numbers, revenue or profit, search-engine rankings, website traffic, legal recognition, accreditation, state approval, acceptance of records or diplomas, uninterrupted service, error-free software, specific educational outcomes, or that any feature will satisfy every customer's individual needs.
24. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website, platform, content, curriculum, and services are provided "as is" and "as available."
ACS Virtual Church disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and results.
25. LIMITATION OF LIABILITY
To the fullest extent permitted by law, ACS Virtual Church and its leaders, officers, workers, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
Total liability arising from a paid service will not exceed the amount the customer paid ACS Virtual Church for the specific service during the six months immediately preceding the event.
26. INDEMNIFICATION
The customer agrees to defend, indemnify, and hold harmless ACS Virtual Church from claims, losses, penalties, liabilities, damages, judgments, and reasonable legal expenses arising from the customer's operations, violations of law, content, disputes, misrepresentations, or breach of these Terms.
27. TERMINATION
ACS Virtual Church may suspend or terminate services for nonpayment, misuse, security concerns, unlawful activity, harassment, threats, material breach, reputational harm, or other conduct that places ACS Virtual Church or its users at risk.
Termination does not eliminate unpaid balances or create a right to a refund.
28. DISPUTE RESOLUTION AND ALABAMA LAW
Before filing a legal claim, the parties agree to attempt in good faith to resolve the dispute through written notice and at least 30 days of informal discussion.
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings must be brought in the state courts located in or serving Geneva County, Alabama, or the federal courts having jurisdiction over Geneva County, Alabama.
29. CHANGES TO THESE TERMS
ACS Virtual Church may update these Terms as services, technology, or laws change. The updated Terms will be posted with a revised effective date. Continued use after an update constitutes acceptance.
30. GENERAL TERMS
If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Refund Policy, and any written order or invoice constitute the agreement relating to the website and services.

ACS Virtual Church respects the privacy of visitors, members, donors, customers, and users of ACSVirtualChurch.com. This Privacy Policy explains how ACS Virtual Church ("ACS," "we," "us," or "our") collects, uses, stores, and shares information.
1. INFORMATION WE MAY COLLECT
Depending on how you use the website or services, we may collect:
- Name, email address, telephone number, mailing address, and contact information;
- Account usernames, encrypted passwords, login records, and security information;
- Membership information and answers provided during membership registration;
- Prayer requests and whether a request is marked private;
- Contact-form messages and areas of interest;
- Donation and transaction information;
- Church-school intake information;
- Church, ministry, school, administrator, and business information;
- School names, domains, logos, branding, policies, documents, content, and uploaded files;
- Student, parent, attendance, enrollment, and school-record information processed through a customer's church-school system;
- IP address, browser type, device information, operating system, referring page, pages visited, and technical logs;
- Cookies, analytics data, session information, and similar technology; and
- Other information you voluntarily provide.
2. PAYMENT INFORMATION
Payments and donations are processed by third-party payment processors such as Stripe. ACS Virtual Church does not normally receive or store complete payment-card numbers. We may receive transaction identifiers, payment status, billing contact information, and limited payment-method details.
3. HOW WE USE INFORMATION
We may use information to operate and improve the website; create and manage accounts; verify users; process purchases and donations; build and maintain church-school systems; provide hosting, support, and customer service; respond to messages and prayer requests; send confirmations and service communications; protect the security of our systems; detect fraud; maintain records; enforce our agreements; and comply with legal obligations.
4. CHURCH-SCHOOL CUSTOMER DATA
Church schools built for customers are independently operated by those customers. The customer operating a church school is responsible for determining what parent and student information it collects and for providing required privacy notices and obtaining required consent.
Parents and students seeking to access, correct, or delete records maintained by an independently operated school should contact that school directly.
5. PRAYER REQUESTS
Prayer requests may contain religious, personal, family, health, or other sensitive information. Requests marked private are intended to be limited to church leadership or authorized prayer personnel. Do not submit information about another person without permission.
6. MEMBER DIRECTORY
Information included in a member directory may be visible to authenticated church members or authorized administrators. Members may not use directory information for unsolicited marketing, harassment, public distribution, scraping, resale, or unlawful purposes.
7. COOKIES, ANALYTICS, AND SESSION TECHNOLOGY
We may use cookies and similar technologies to keep users signed in, remember preferences, maintain website security, understand how visitors use the website, diagnose technical problems, improve performance, and prevent fraud and abuse.
Sensitive fields such as passwords, payment-card information, private prayer requests, student records, and confidential intake information should be excluded or masked from session recordings whenever supported by the technology.
Users may control certain cookies through browser settings, although disabling cookies may prevent some features from working.
8. HOW WE SHARE INFORMATION
We may share information with website-hosting and cloud-storage providers; payment processors; email and communication providers; domain registrars; analytics and security providers; contractors who help build or support our systems; professional advisers; government authorities when legally required; a successor organization in connection with a merger or transfer; and other parties when you authorize disclosure.
ACS Virtual Church does not currently sell or rent personal information for money.
9. LEGAL AND SAFETY DISCLOSURES
We may preserve or disclose information when we reasonably believe it is necessary to comply with legal process; protect rights, safety, or security; investigate fraud or unlawful activity; enforce our policies; or respond to an emergency involving potential harm.
10. DATA RETENTION
We retain information for as long as reasonably necessary to provide services, maintain records, resolve disputes, enforce agreements, meet legal obligations, and support legitimate purposes. Information may be deleted or made inaccessible when no longer needed.
11. DATA SECURITY
We use reasonable administrative, technical, and organizational measures designed to protect information. However, no system is completely secure. We cannot guarantee absolute security. Users are responsible for protecting their passwords and notifying us of suspected unauthorized access.
12. CHILDREN'S PRIVACY
ACSVirtualChurch.com membership accounts, purchases, donations, and service agreements are intended for adults. Children under 13 should not create accounts or submit personal information directly through the ACS Virtual Church website.
A parent, legal guardian, church, or independently operated school must provide or authorize information concerning a child when legally permitted.
Operators of customer church-school systems are responsible for determining whether children's privacy laws apply to their operations and for obtaining any required parental consent.
13. YOUR CHOICES
You may contact us to request access to personal information, correction of inaccurate information, deletion of information (when legally and technically permitted), removal from optional communications, or closure of your account.
14. THIRD-PARTY LINKS
The website may link to or display content from Stripe, YouTube, domain registrars, other schools, social platforms, and third-party websites. Third parties control their own privacy practices.
15. UNITED STATES PROCESSING
Information may be processed and stored in the United States or other locations used by our service providers.
16. CHANGES TO THIS POLICY
We may update this Privacy Policy when our services, practices, technology, or legal obligations change. The updated policy will be posted with a revised effective date.

No-Refund & Cancellation Policy

ALL SALES ARE FINAL.
By purchasing a product or service, starting a subscription, making a donation, or authorizing payment to ACS Virtual Church, the customer acknowledges and agrees to this No-Refund and Cancellation Policy.
1. NO REFUNDS
Except where a refund is expressly required by law, ACS Virtual Church does not provide refunds, partial refunds, prorated refunds, credits, exchanges, or reimbursements.
This policy applies regardless of whether the customer uses, accesses, completes, downloads, implements, or benefits from the purchased product or service.
2. SETUP FEES
All church-school system setup fees are final and nonrefundable. The setup fee reserves project availability and covers planning, intake review, system configuration, design preparation, administrative work, software access, and other work that may begin shortly after payment.
The setup fee remains nonrefundable if the customer changes their mind, decides not to open a school, cannot legally establish a church school, fails to provide information, delays or abandons the project, dislikes a design, requests work outside scope, does not obtain expected results, or violates the Terms of Service.
3. CUSTOM SERVICES AND ADD-ONS
Payments for custom websites, custom programming, additional pages, special features, branding, content preparation, integrations, document creation, consulting, upgrades, and add-on services are final and nonrefundable.
4. CURRICULUM AND DIGITAL PRODUCTS
All curriculum packages, lesson plans, worksheets, assessments, templates, downloads, digital documents, and other digital products are final and nonrefundable. Digital products cannot be returned once access has been granted, files have been delivered, or work has begun.
5. MONTHLY SERVICE
Monthly service payments are final and nonrefundable. Cancellation stops future renewal charges but does not provide a refund or credit for the current month. Failure to use the services does not create a right to a refund.
6. PREPAID PLANS
Quarterly, semiannual, and annual service plans are prepaid commitments offered at a discounted rate. All prepaid service payments are final and nonrefundable. If a customer cancels before the prepaid period ends, the service may remain available through the end of the paid period, but no refund, credit, or prorated reimbursement will be issued for unused time.
7. DOMAIN AND THIRD-PARTY COSTS
Domain registration, domain renewal, hosting, software, processing, licensing, transfer, premium-domain, and other third-party costs are final and nonrefundable.
8. DONATIONS AND TITHES
Tithes and donations are voluntary, final, and nonrefundable except where reversal is required by law or ACS Virtual Church confirms that a payment was an unauthorized or duplicate transaction.
9. REVISION REQUESTS
Customers receive seven calendar days after completion notice to request reasonable minor revisions covered by the original project scope. A revision request does not create a right to a refund. Work outside the original scope may require an additional nonrefundable payment.
10. CUSTOMER DELAYS OR ABANDONMENT
Payments will not be refunded when work is delayed, suspended, archived, or terminated because the customer failed to provide information, content, access, approval, payment, or a timely response.
11. CANCELLING FUTURE RENEWALS
To cancel future recurring billing, email: acsvirtualchurch@gmail.com
The cancellation request must be received before the next billing date. Not using the service does not automatically cancel it.
12. FAILED PAYMENTS AND SUSPENSION
Services may be suspended or terminated when a payment is declined, late, reversed, disputed, or unpaid. Suspension or termination for nonpayment does not create a right to a refund.
13. PAYMENT DISPUTES AND CHARGEBACKS
Customers should contact ACS Virtual Church before initiating a payment dispute or chargeback. Filing a chargeback does not automatically cancel a subscription or eliminate amounts lawfully owed.
Fraudulent or abusive chargebacks may result in permanent termination of services and collection of legally recoverable balances, processing fees, and costs.
14. ACS VIRTUAL CHURCH CANCELLATION
If ACS Virtual Church elects not to accept a project and cancels it before substantive work begins, ACS Virtual Church may, at its discretion, void or return the applicable payment.
If ACS Virtual Church terminates service because of customer misconduct, nonpayment, breach, unlawful activity, security concerns, threats, harassment, or misuse, payments remain nonrefundable.
15. ACCEPTANCE
By submitting payment, the customer confirms that they read this policy before purchasing, understand that all sales are final, authorize any disclosed recurring billing, understand how to cancel future renewals, and agree that cancellation does not result in a refund for amounts already paid.
